Welcome to the Mzansi Tournament App, a sports management and community engagement platform operated by FreshCheck Monitors (Pty) Ltd (“we”, “us”, “our”, or “the Company”).

Mzansi Tournament enables organizers to create and manage tournaments, generate fixtures, tables, and results, and connect teams, schools, and communities across multiple sports such as soccer, rugby, and pool.

By using our platform, you agree to these Terms and Conditions and acknowledge that Mzansi Tournament is owned and managed by FreshCheck Monitors (Pty) Ltd.

ACCEPTANCE OF TERMS

By registering for or using Mzansi Tournament, you agree that:

• You are 16 years or older (or have parental consent if under 16).
• You have read, understood, and accepted these Terms in full.
• You are authorized to represent any organization or team you register.

If you do not agree to these Terms, please do not use the app or its services.

PURPOSE OF THE PLATFORM

The Mzansi Tournament platform aims to:

• Digitize the organization and management of local sports tournaments.
• Help schools and communities efficiently run competitions.
• Promote youth development and keep young people away from drugs and crime.
• Encourage sports participation, teamwork, and discipline across South Africa.

PLATFORM OWNERSHIP

The Mzansi Tournament App and all related services are developed and maintained by FreshCheck Monitors (Pty) Ltd, a private company based in South Africa.

All intellectual property, including logos, designs, databases, and software, remains the property of FreshCheck Monitors.

USER ACCOUNTS

To access certain features, users must create an account. By doing so, you agree to:

• Provide accurate and up-to-date information.
• Keep your login credentials confidential.
• Accept full responsibility for all activities under your account.

FreshCheck Monitors reserves the right to suspend or terminate accounts found to be violating these Terms or engaging in misuse of the platform.

ORGANIZER RESPONSIBILITIES

If you are a tournament organizer using Mzansi Tournament, you agree to:

• Provide truthful and accurate tournament information.
• Ensure fair play and good sportsmanship.
• Avoid uploading or sharing harmful, offensive, or false content.
• Manage your tournaments in compliance with community and school regulations.

FreshCheck Monitors will not be held responsible for disputes, misconduct, or injuries arising from tournaments organized via the platform.

FEES AND PAYMENTS

Tournament organizers may be charged a service fee for creating or managing tournaments on the platform.

All payments are made directly to FreshCheck Monitors (Pty) Ltd and are non-refundable unless otherwise specified.

After tournament completion, users may choose to retain tournament data for historical purposes at an additional monthly hosting fee (as described in our pricing policy).

CONTENT OWNERSHIP AND LICENSE

Users retain ownership of their uploaded content (e.g., tournament names, logos, and results).

By uploading content to the platform, you grant FreshCheck Monitors (Pty) Ltd a non-exclusive, royalty-free license to:

• Display and share your tournament publicly within the app.
• Use your tournament name or logo for promotional or community impact purposes.

PROHIBITED USES

Users may not:

• Post illegal, abusive, or misleading content.
• Manipulate match results or falsify team data.
• Upload harmful code or attempt to disrupt the platform.
• Use the Mzansi Tournament App for unlawful or unethical purposes.

Violation of these rules may result in permanent account suspension and removal of associated content.

LIMITATION OF LIABILITY

FreshCheck Monitors (Pty) Ltd provides the Mzansi Tournament App “as is” without warranties of any kind.

We are not responsible for:

• Losses or damages caused by the use or inability to use the app.
• Errors or delays in data updates (e.g., fixtures or results).
• Organizer or participant misconduct during tournaments.

All tournaments are managed independently by their respective organizers.

TERMINATION OF SERVICE

FreshCheck Monitors reserves the right to:

• Suspend or terminate user access for violations of these Terms.
• Remove tournaments or data that breach community standards.

Upon termination, all user data may be permanently deleted, unless retained under an active hosting agreement.

PRIVACY AND DATA PROTECTION

FreshCheck Monitors values your privacy. Personal information collected via Mzansi Tournament will only be used for platform operations, tournament management, and communication purposes.

COMMUNITY IMPACT

Mzansi Tournament, under FreshCheck Monitors, is committed to uplifting local communities through sports.

Our long-term goal is to partner with sponsors and use part of our revenue to support school and community tournaments with equipment, prizes, and youth programs.

CHANGES TO TERMS

FreshCheck Monitors (Pty) Ltd may revise these Terms at any time. Updates will be posted within the app and/or sent to registered users.

Continued use of the app after changes means you accept the new Terms.
